Terms & Conditions for Ghost Zero

  1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the website ghost000.com (the “Website”) and the services offered by Ghost Zero (“we,” “us,” or “our”), including our SMS messaging program (collectively, the “Services”). By accessing or using the Website or Services, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Website or use the Services.  

 

  1. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.  

 

  1. Account Registration

To access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.  

 
 
 

  1. Services

Ghost Zero provides marketing services, which may include, but are not limited to, strategy development, content creation, social media management, search engine optimization (SEO), paid advertising, and SMS marketing. The specific services provided to you will be outlined in a separate agreement or statement of work.

  1. SMS Messaging Program

    1. Opt-In: By providing your phone number and checking the opt-in checkbox on our Website forms https://ghost000.com/contact/ or by texting ‘START’ to +1 833-540-2473

       , you consent to receive SMS messages from Ghost Zero. These messages may include project updates, meeting confirmations, performance reports, invitations to strategy calls, and occasional promotional offers related to our marketing services. Message and data rates may apply.

    1. Opt-Out: You can opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. You will receive a confirmation message of your opt-out.
    1. Message Frequency: Message frequency may vary, but we will strive to send no more than 15 messages per month, excluding transactional messages directly related to a specific project or request.
    1. Support: For help or information regarding our SMS program, reply HELP to any message, or contact us at hello@ghost000.com.
    1. Carrier Liability: Carriers are not liable for delayed or undelivered messages.

  7. 6. Privacy: Our use of your phone number and other information related to the SMS program is governed by our Privacy Policy, available at https://ghost000.com/privacy-policy/ .

  8. Fees and Payment

Fees for our Services will be as set forth in the applicable agreement or statement of work. You agree to pay all fees in accordance with the payment terms specified.

  1. Intellectual Property

All content on the Website and provided as part of the Services, including text, graphics, logos, images, and software, is the property of Ghost Zero or its licensors and is protected by copyright and other intellectual property laws. You may not use, reproduce, distribute, or create derivative works from our content without our express written permission. Any deliverables created for you as part of a paid service engagement are typically assigned to you as the client, but this must be explicitly stated in your client agreement. This Terms of Service does not automatically transfer ownership of work product.  

 
 
 

  1. Prohibited Conduct

You agree not to:

*   Use the Services for any illegal or unauthorized purpose.
*   Violate any applicable laws or regulations.
*   Infringe upon the intellectual property rights of others.
*   Send spam or other unsolicited messages.
*   Transmit any viruses, malware, or other harmful code.
*   Interfere with or disrupt the Services or servers or networks connected to the Services.
*   Attempt to gain unauthorized access to the Services or any other user's account.
*   Harass, abuse, or threaten any other user of the Services.
*   Use the SMS program to send any prohibited content, including but not limited to, content that is illegal, fraudulent, defamatory, obscene, threatening, or violates the rights of others.
* Use SHAFT (Sex, Hate, Alcohol, Firearms, Tobacco) content.

  1. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.  

 
 

  1. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.  

 
 
 

  1. Limitation of Liability

IN NO EVENT SHALL GHOST ZERO, ITS DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US, IF ANY, FOR THE SERVICES DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.  

 
 
 

  1. Indemnification

You agree to indemnify and hold harmless Ghost Zero, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of the Services or your violation of these Terms.  

 
 

  1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Utah, without regard to its conflict of law principles.

  1. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association in Salt Lake City, UT. The arbitration shall be conducted by a single arbitrator. The arbitrator’s decision shall be final and binding. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.  

 
 
 

  1. Changes to these Terms

We may update these Terms from time to time. We will notify you of any changes by posting the new Terms on this page and updating the “Last Updated” date. You are advised to review these Terms periodically for any changes.  

 
 

  1. Entire Agreement These terms, along with our Privacy Policy, are the complete agreement between Ghost Zero and you.
